Do I have to pay upfront?
No, I charge on a contingency basis, which means that I take a percentage of your recovery. You don’t pay me unless we win.
Should I give a statement?
No, you are not required to give a statement to the other person’s insurance company, and it is usually not beneficial to do so without counsel.
Do you do just PD?
No. As discussed above, I charge on a contingency fee basis. If I took a percentage of your car repair amount, you would not have enough money to get the repairs done.
What if the limit aren't enough?
This is a sad situation that happens too often. Many times, people are undercompensated for their injuries. This is one reason that I recommend that everyone purchase uninsured/underinsured motorist coverage.
How long will this take? How much?
Be wary of any attorney that gives you definitive answers to these two questions at the beginning of a case. It is impossible to know how long a case will take or how much it will be worth early on in the process. Some cases resolve in a few months and some take many years. Usually the two biggest factors are how severe a person’s injuries are and how much insurance coverage is available.
Can I keep car?
Yes, you have the option to retain your wrecked vehicle. It will reduce the amount you receive for the vehicle, as you are keeping what is called the “salvage” value (which is the amount that the insurance company could get for the vehicle if they sold it for scrap).
Can I switch attorneys?
Yes, sometimes. You are always allowed to fire your attorney if you don’t like them and seek new counsel. Practically speaking, it can sometimes be difficult to find a new attorney to take your case, depending on how long the case has been pending, how much work has already occurred, and other factors.
